Please read these Terms and Conditions (“Terms”) carefully before using sugarrushbymb.com (the “Site”) or placing orders (the “Service”). By accessing or using the Site, placing orders, or otherwise interacting with us, you agree to be bound by these Terms.

1. Acceptance & Eligibility

• You agree to comply with all applicable laws and regulations.
• We may refuse service, terminate accounts, or cancel orders at our discretion (for violations, fraud, etc.).

2. Account Registration & Security

• To place orders or access features, you may create an account with a username and password.
• You are responsible for maintaining confidentiality of your login credentials and all activities under your account.
• You must notify us immediately of any unauthorized use or security breach.

3. Ordering & Payment

• All orders must be placed and paid in full before preparation begins.
• Payment is processed securely through our website or in person.
• We do not accept cancellations or refunds once your order is confirmed, as all items are made fresh and perishable.

Pickup Policy

• Orders must be picked up at the agreed time and location.
• Please inspect your order upon pickup.
• If an order appears incorrect or damaged, let us know immediately before leaving the shop so we can resolve it on the spot.
• Once an order has been accepted and taken, we cannot be held responsible for issues that arise afterward (e.g., melting, handling, transport).

Delivery

• We do not offer direct delivery.
• Customers who use third-party apps (e.g., DoorDash, Uber Eats) are subject to that company’s delivery terms and policies. We are not responsible for delays or damages caused during third-party delivery.

Custom Orders

• Custom and specialty desserts (e.g., cakes, cupcakes, treat boxes) may require advance notice and specific design details.
• We will do our best to match your requests, but slight variations in color, decoration, or design may occur — each dessert is handmade.

Returns & Refunds

• All sales are final.
• Because our items are perishable, we do not accept returns or issue refunds.
• If there is an error on our part, please contact us immediately upon pickup so we can make it right.

Pricing & Availability

• Prices and availability are subject to change without notice.
• Occasionally, an item may become unavailable after an order is placed. In such cases, we’ll contact you to adjust or refund as appropriate.

4. Allergies & Food Safety

• Our products are made in a kitchen that may contain or come into contact with allergens, including nuts, gluten, dairy, soy, and eggs.
• Customers are responsible for informing us of any allergies before ordering.
• We cannot guarantee an allergen-free environment.

5. Intellectual Property

• All content on the Site (text, logos, images, designs) is our property or licensed to us.
• You may not reproduce, modify, distribute, or republish our content without our written consent.
• If you submit content (reviews, photos) to us, you grant us a non‑exclusive, royalty-free license to use and display it.

6. User Conduct

You agree not to use the Site to:

9. Governing Law & Dispute Resolution
